OFFICIAL RULES FOR THE RÉMY MARTIN® PRODUCERS SERIES SEASON 3 CONTEST

VOID OUTSIDE THE UNITED STATES AND WHEREVER PROHIBITED. DO NOT ENTER THIS CONTEST IF YOU ARE NOT 25 YEARS OR OLDER. DO NOT ENTER THIS CONTEST IF YOU ARE NOT A LEGAL RESIDENT OF AND CURRENTLY RESIDING IN THE 50 UNITED STATES OR IN THE DISTRICT OF COLUMBIA. THIS CONTEST WILL BE CONSTRUED AND EVALUATED IN ACCORDANCE WITH UNITED STATES LAW.

 

The Rémy Martin® Producers Series Season 3 contest (the “Contest”) period opens on October 5, 2016, at 12:00:01 am/EST; and will close on November 15, 2016, at 11:59:59 pm/EST for the Western division [Los Angeles (CA), San Francisco(CA)] and November 27, 2016, at 11:59:59 pm/EST for the Central division [Chicago (IL), Cleveland (OH), Detroit (MI), Indianapolis (IN), Milwaukee (WI), St. Louis (MO)] (the “Contest Period”).

1. SPONSORS

The Contest is sponsored by Rémy Cointreau USA, Inc., with an address of 1290 Avenue of the Americas, New York, NY 10104 (hereinafter referred to as the “Sponsors”).

2. ELIGIBILITY

The Contest is open to legal and current residents of the 50 United States and District of Columbia (“D.C.”) who are twenty-five (25) years of age or older as of October 5, 2016. The Contest is subject to all applicable federal, state and local laws, rules and regulations, and is void outside the United States, D.C. and where prohibited by law. The Contest is void outside the 50 United States and D.C. and where prohibited by law.

Employees, officers and directors of the Sponsors, their parent companies, divisions, subsidiaries, affiliates, and advertising and promotion agencies of each of the foregoing, distributors and retailers, and any other entity that develops, produces, or distributes materials for or related to this Contest, and the immediate family members or households (whether related or not) of any of the above are not eligible to participate or win.

3. HOW THE CONTEST WORKS

  1. The Sponsors host a series of ten (10) events that will feature top-tier producers as performers and judges of a producer contest.

  2. Amateur producers will submit their best tracks to the Contest microsite (http://remyproducers.com) for the opportunity to compete in the semi-final rounds.

    1. Tracks submitted should be instrumentals, no longer than one (1) minute in length.

    2. Contestants can enter more than one track.

    3. If not selected for one date, they may be selected for a later date.

  3. Three (3) to six (6) producers will be selected for each of the eight semi-final rounds of the Contest.

  4. The events will be three (3) hours long: 3pm-6pm or 7pm-10pm.

  5. For each round, semi-finalists will provide five (5) labeled battle tracks in .mp3 format to the DJ, who will play them as requested.

  6. The amateur producers’ tracks will be critiqued and judged by a panel of music industry professionals including the professional producer.

  7. Crowd participation will also account for 10% of the voting. The crowd will be able to vote via Twitter by tweeting the name of their choice of producers with the hashtag: #remyproducers.

  8. Four (4) semi-finalists will be selected from the West for the Western Division finale in Los Angeles; and six (6) semi-finalists will be selected from the Central Division to move on to the Central Finale in Chicago.

  9. There will be a finale in each division to crown one winner per division with the grand prize.

  10. At the finale event in each division, a panel of music industry professionals will judge a series of tracks from each finalist.

    1. The finale will consist of three (3) rounds, each eliminating a finalist.

    2. The final round will determine the winner.

    3. If there is a tie, there will be a Sudden Death round–each producer will have 3 minutes to play as many tracks as they see fit in order to win.

  11. Crowd participation will also account for 10% of the voting at the finale. The crowd will be able to vote via Twitter by tweeting the name of their choice of producers with the hashtag: #remyproducers.

  12. One amateur producer will win the Grand Prize in each division.

4. HOW TO ENTER

  1. The Rémy Martin® Producers Series Season 3 Contest is for amateur and semi-professional producers. If a producer has had a song that they produced in the Top 100 of any charts (i.e. Billboard, iTunes, Spotify, etc), in the last year, the producer is not eligible for the competition.

  2. Amateur producers may submit one track per judging sequence for each of the eight competition dates: 10/22, 11/19 (Western Division); and 11/3, 11/5, 11/12, 11/17, 12/1, 12/3 (Central Division).

  3. If “Producer A’s” track is chosen as a winner at one of the eight competition dates, the producer is no longer eligible to compete at the rest of the competition dates. The producer will only be eligible to compete in the final competition in their corresponding division.

  4. All tracks for the producer contest must be submitted to the Rémy Producers microsite (http://remyproducers.com).

  5. Producers can submit multiple entries for each date; but each entry must be a different track.

  6. Producers can enter the same track for all semi-final competition dates, but if the track is selected at any point, it will be withdrawn from the following competition dates.

  7. Producers can enter up to eight (8) separate tracks for the competition days.

  8. All producers chosen for the final competition rounds in each division must have multiple tracks to be judged for the final competition on 12/10 for Western Division Finale and 12/17 for the Central Division Finale.

  9. All tracks for the finale should be submitted by, November 15, 2016 for the Western division and November 27, 2016 for the Central division, in order to be cleared by our music experts.

  10. By submitting music to the Contest, producers are affirming that they are the owner and have created the submitted music.

    1. All responsibility for samples, sample clearance, chord or simulation of existing tracks is the sole responsibility and legal obligation of the producer submitting the tracks for competition.

    2. Rémy Martin®, Urban Ideation and Unruly Records bear no responsibility or obligation for any lawsuits or grievances that may arise from the submission of music.

  11. The music submitted for this program will remain the property of the producer that submitted them; but by submitting the music the producer/owner gives permission to Rémy Cointreau USA, Inc., Urban Ideation and Unruly Records license to use the music for promotional, advertising and presentation purposes.

5. SELECTION OF CONTESTANTS

  1. Amateur producer selection will be conducted by Event Managers and a panel of music industry veterans.

  2. Contestants must submit entries to the Rémy Producers microsite (http://remyproducers.com) by prescribed dates mentioned above.

  3. Event Managers will select three (3) to six (6) of the best tracks per competition round to be critiqued and analyzed by our professional producer and panel of music industry judges.

  4. Contestants will be notified by Event Managers and must be present at their competing event.

6. JUDGING

Semi-Final Rounds:

  1. Judging will take place at the event, with a panel three (3) to five(5) judges, comprised of music industry veterans, artists, producers and tastemakers.

  2. Judges will listen to each of the tracks and give a rating of 1 (not good) to 10 (very good).

  3. The selected tracks will be based on the following:

    1. Originality

    2. Complexity

    3. Production Quality

    4. Ability To Move The Crowd

    5. Radio/Club Hit Readiness

  4. The judges’ votes will be tallied with the crowd vote via Twitter (10%), and the highest score will advance.

  5. If there is a tie, the winner will be decided by crowd applause.

  6. Judges are tasked with choosing one track to advance; but under special circumstances, if deemed necessary, may advance more than one to the final round.

Grand Finale:

  1. At the finale, producers may continue to use the track that won in the semi-final events and may enter other tracks to be judged.

  2. Finale judging will take place at the event, with a panel three (3) to five (5) judges, comprised of music industry veterans, artists, producers and tastemakers.

  3. Finale judges will listen to each of the tracks and give a rating of 1 (not good) to 10 (very good).

  4. The selected tracks will be based on the following:

    1. Originality

    2. Complexity

    3. Production Quality

    4. Ability To Move The Crowd

    5. Radio/Club Hit Readiness

  5. The judges’ votes will be tallied with the crowd vote via Twitter (10%), and the highest score will be crowned as the winner.

  6. If there is a tie, the winner will be decided by crowd applause.

7. PRIZES

Grand Prize:

  1. There will be two Grand Prize winners (one for each division) chosen at the final competition event in the corresponding division.

  2. Each of the final event winners will receive: a $4,500.00 Guitar Center gift card, a Winner’s plaque, and an Under Armour jacket (valued at $150).

Semi-final Prizes:

  1. There will be a total of ten (10) semi-final event winners: two (2) for each event in the Western division, and one (1) for each event in the Central division.

  2. Each of the ten (10) semi final event winners will receive a prize pack (prizes to be determined at the discretion of the Sponsor).

8. GENERAL RULES OF PARTICIPATION

  1. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsors, which shall be final, and waive any right to claim ambiguity in the Contest or these Official Rules. In the event of a dispute, the decision of the Sponsors shall be final and binding.

  2. All federal, state and local laws apply. All federal, state or other tax liabilities arising from this Contest will be the sole responsibility of the prize winners.

  3. The Sponsors, their parent companies, affiliates, subsidiaries and advertising and promotion agencies are not responsible for and shall not be liable for: (i) late, lost, delayed, misdirected, incomplete or unintelligible entries, telephone system or computer malfunctions, lost connections or transmission errors; (ii) any injuries, losses or damages of any kind caused by the acceptance, possession or use of any prize or from participating in the Contest; or (iii) any printing, typographical, administrative or technological errors in any material associated with the Contest.

  4. Sponsors reserve the right, in their sole discretion, to modify, cancel or suspend this Contest should a virus, bug, computer problem or other causes beyond the Sponsors’ control corrupt the administration, security or proper play of the Contest.

  5. The Sponsors may prohibit you from participating in the Contest or winning a prize if, in their sole discretion, the Sponsors determine that you are attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other players or Sponsor’s representatives.

CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION OF SUCH PARTICIPANT AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

  1. All entries and the information contained in such entries will become the property the Sponsors and will not be acknowledged or returned.

  2. Participation in the Contest will constitute permission for the Sponsors to use the names, cities, states, likenesses, and voices of the winners for advertising and promotional purposes, without any further compensation, unless prohibited by law.

9. OWNERSHIP OF EVENT’S INTELLECTUAL PROPERTY

  1. By entering tracks into the Rémy Martin® Producers Series Season 3 Contest, Amateur Producers are allowing Rémy Cointreau USA, Inc., Urban Ideation and Unruly Records to use the tracks for promotional and advertising purposes only, in perpetuity.

  2. Amateur Producers ultimately retain the rights to the tracks they enter, after a 1-year promotional period.

  3. If the tracks selected for the Contest are sold or start to gain traction in the mainstream market, the Amateur Producer will maintain all rights to profits from the track.

  4. Rémy Cointreau USA, Inc., Urban Ideation and Unruly Records will be allowed to use all musical tracks entered in the contest for promotional and advertising purposes.

10. LIMIT OF LIABILITY AND DISCLAIMERS

  1. ALL ENTRANTS AGREE THAT THE SPONSORS, THEIR PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AND AGENCIES AND/OR ANY OTHER PERSON OR ENTITY ASSOCIATED WITH THE CONTEST SHALL NOT BE LIABLE FOR CLAIMS, LOSSES, LIABILITIES, EXPENSES OR INJURIES OF ANY KIND RESULTING IN ANY WAY FROM ENTRANTS PARTICIPATION IN THE CONTEST, INCLUDING BUT NOT LIMITED TO, THE DRAWING, THE USE OF THE PRIZE, ANY DELAYED, LOST, MISDIRECTED, OR DAMAGED ENTRIES, OR ANY COMPUTER, ONLINE SERVICE, COMMUNICATIONS OR OTHER TECHNICAL MALFUNCTIONS THAT MAY OCCUR.

  2. ALL ENTRANTS ACKNOWLEDGE THAT THE SPONSORS, THEIR PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AND AGENCIES AND/OR ANY OTHER PERSON OR ENTITY ASSOCIATED WITH THE CONTEST MAKE NO WARRANTY OF ANY NATURE, EXPRESS OR IMPLIED REGARDING THE PRIZES, WHETHER WITH RESPECT TO FITNESS FOR PURPOSE, SATISFACTORY QUALITY, DESCRIPTION OR NATURE OF THE PRIZE OR OTHERWISE. ALL ENTRANTS, BY ENTERING THE CONTEST, AGREE TO BE BOUND BY THE ABOVE RULES.

11. DISPUTES / CHOICE OF LAW

Except where prohibited, each entrant agrees that this Contest shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules. Sponsors reserve the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of this Contest, including without limitation barring entrants who do not comply with these Official Rules. By entering, entrants consent to the jurisdiction and venue of the appropriate federal, state and local courts located in New York for any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded.

13. USE OF INFORMATION

The information that you provide via interactive media in connection with the Contest may be used by Sponsor, Marketing Affiliate, and Related Entities in accordance with its Privacy Policy, which is found at http://remyproducers.com/privacy-policy/ and which may be updated from time to time without notice.
