DO NOT ENTER THIS CONTEST IF YOU ARE NOT A LEGAL RESIDENT OF AND CURRENTLY RESIDING IN THE 50 UNITED STATES OR IN THE DISTRICT OF COLUMBIA. NO PURCHASE IS NECESSARY TO ENTER CONTEST. The Rémy Martin® Producers Series Season 4 (the “Contest”) national submissions period (the “Submission Period”) opens on July 21, 2017, at 5:00:00 p.m. EST; and closes on

  1. August 10, 2017 at 11:59:59 p.m. EST for the Chicago Preliminary

  2. August 17, 2017 at 11:59:59 p.m. EST for the Detroit Preliminary

  3. August 19, 2017 at 11:59:59 p.m. EST for the Cleveland Preliminary

  4. August 23, 2017 at 11:59:59 a.m. EST for the Miami Preliminary

  5. August 24, 2017 at 11:59:59 p.m. EST for the Indianapolis Preliminary

  6. August 25, 2017 at 11:59:59 p.m. EST for the St. Louis Preliminary

  7. August 31, 2017 at 11:59:59 pm/EST for all other Preliminary Events.

Contest events will take place between August 17, 2017 and November 9, 2017 (“the Contest Period”).

1. SPONSOR & EVENT MANAGERS

The Contest is sponsored by Rémy Cointreau USA, Inc., with an address of 1290 Avenue of the Americas, New York, NY 10104 (hereinafter referred to as the “Sponsor”).

The Contest is managed by Urban Ideation / Unruly Records for the Sponsor (hereinafter referred to as the “Event Managers”).

2. ELIGIBILITY

The Contest is open to legal and current residents of the 50 United States and District of Columbia (“D.C.”) who are twenty-five (25) years of age or older as of July 21, 2017. The Contest is subject to all applicable federal, state and local laws, rules and regulations, and is void outside the United States, D.C. and where prohibited by law. The Contest is void outside the 50 United States and D.C. and where prohibited by law.

Employees, officers and directors of the Sponsor, their parent companies, divisions, subsidiaries, affiliates, and advertising and promotion agencies of each of the foregoing, distributors and retailers, and any other entity that develops, produces, or distributes materials for or related to this Contest, and the immediate family members or households (whether related or not) of any of the above are not eligible to participate or win.

3. HOW THE CONTEST WORKS

  1. Amateur producers will submit their best tracks to the Contest microsite (http://remyproducers.com) during the Submission Period for the opportunity to compete.

  2. Event Managers select and confirm the producers who will compete in the Contest.

  3. The Sponsor hosts a series of nineteen (19) events during the Contest period—thirteen (13) Preliminaries, five (5) Semifinals, and one (1) Grand Finale—that will feature top-tier producers and a panel of judges from the music industry.

  4. PRELIMINARIES

    1. Three (3) producers will be selected for each of the thirteen (13) Preliminaries, totaling thirty-nine (39) qualifying contestants.

    2. For each Preliminary, contestants will provide five (5) labeled battle tracks in .mp3 format (as specified in Section 4. “How to Enter”) to the DJ, who will play them as requested. Tracks submitted during the entry process may be used.

    3. The amateur producers’ tracks will be critiqued, judged and scored by a panel of music industry professionals including the professional producer.

    4. Amateur producers will compete in two (2) rounds. The amateur producer with the highest score after both rounds at each Preliminary will advance to one of five national Semifinals, a total of thirteen (13) Preliminary winners.

    5. In the event of a tie, crowd voting will be used to determine the Winner.

    6. Wildcards: After the final preliminary, the judges will select two (2) Wildcard contestants who scored high and showed exceptional promise, from the pool of twenty-six (26) producers who did not win their Preliminary event. These two (2) Wildcards will join the thirteen (13) Preliminary winners to compete at the Semifinals.

  5. SEMIFINALS

    1. The fifteen (15) semifinalists will be routed by Event Managers to compete at five (5) national semifinal events.

    2. Each Semifinal event will feature three (3) competing producers.

    3. Semifinalists will provide five (5) labeled battle tracks in .mp3 format (as specified in Section 4. “How to Enter”) to the DJ, who will play them as requested. Tracks submitted during the entry process or played at Preliminaries may be used.

    4. The amateur producers’ tracks will be critiqued, judged and scored by a panel of music industry professionals including the professional producer.

    5. Semifinalists will compete in two (2) rounds. The amateur producer with the highest score after both rounds at each Semifinal will advance to the Grand Finale, totaling five (5) finalists.

    6. In the event of a tie, crowd voting will be used to determine the Winner.

  6. GRAND FINALE

    1. The five (5) finalists will compete at the national Grand Finale in Las Vegas, Nevada and one producer will be crowned the winner of the Contest.

    2. Finalists will provide seven (7) labeled battle tracks in .mp3 format to the DJ, who will play them as requested. Tracks submitted during the entry process or played at Preliminaries and Semifinals may be used.

    3. At the finale event, a panel of music industry professionals will judge a series of tracks from each finalist.

    4. The finale will consist of four (4) rounds: a remix round and three (3) knockout rounds.

      1. The Remix round will be judged and scored, but no one will be eliminated. The score total will be carried through to the first knockout round.

      2. The first knockout round will be judged on original tracks and scored. Score will be combined with score from remix round and the producers with the lowest two scores will be eliminated.

      3. The second knockout round will be judged on original tracks and scored. The lowest cumulative scorer will be eliminated.

      4. The final knockout round will be judged on original tracks and scored. The highest cumulative scorer will win.

      5. If there is a tie, the producer with highest cumulative score entering the Grand Finale, will be crowned the winner. If the two (2) tied finalists entered with the same cumulative score, the winner will be determined by crowd vote.

  7. Contestant scores will be tracked and tallied throughout the Contest. Contestant standings can be viewed on the Contest microsite (http://remyproducers.com).

5. HOW TO ENTER

  1. No purchase is necessary to enter the Contest.

  2. The Contest is for amateur and semi-professional producers. If a producer has had a song that they produced in the Top 100 of any charts (i.e. Billboard, iTunes, Spotify, etc), in the last twelve (12) months from the start of the Contest Period, the producer is not eligible for the competition.

  3. All tracks for the Contest must be submitted via the Rémy Producers microsite (http://remyproducers.com).

    1. Tracks submitted must be instrumentals, no longer than one (1) minute in length.

    2. All tracks submitted for Contest entry or events must be labeled in the following format: producer-name_track-name.mp3

    3. Contestants can select the Preliminary city in which they would like to compete.

    4. Producers can submit multiple entries for each Preliminary date.

    5. Producers can enter the same track for all Preliminary events, but if the track is selected for a Preliminary event, it will be withdrawn from all other dates.

  4. All Contest entries must be submitted during the Submission Period, to be reviewed and considered by our music experts.

  5. When entering the Contest, an opportunity to sign up to receive follow-ups, information and promotions from Sponsor may be available.

  6. Each entry will be deemed to have been submitted by the authorized account holder of the email address and phone number submitted. Entries not submitted by actual producer will be disqualified. Sponsor and Event Managers will not be held responsible for fraudulent impersonations or unauthorized submissions.

  7. By submitting music to the Contest, producers are affirming that they are the owner and have created the submitted music.

  8. All responsibility for samples, sample clearance, chord or simulation of existing tracks is the sole responsibility and legal obligation of the producer submitting the tracks for the Contest.

  9. You understand and intend that any music track, photo or information submitted by you to the Contest may be available for viewing, rating, review and comment on by the public, and understand that comments or ratings with which you disagree or are unhappy about may be published or otherwise become associated with any music track, photo or information you submit to Contest. By submitting any music track, photo or information to Contest, you hereby waive any privacy expectations that you may have with respect to any such music tracks, photo or information submitted by you to Contest.

  10. Sponsor and Event Managers bear no responsibility or obligation for any lawsuits or grievances that may arise from the submission of music.

  11. The music submitted for this program will remain the property of the producer that submitted them; but by submitting the music the producer/owner gives permission to Sponsor and Event Managers to license to use the music for promotional, advertising and presentation purposes.

6.SELECTION OF CONTESTANTS

  1. Amateur producer selection will be conducted by Event Managers and a panel of music industry veterans.

  2. Contestants must submit entries to the Rémy Producers microsite (http://remyproducers.com) by prescribed dates mentioned above.

  3. Event Managers will select the three (3) best tracks submitted, each by a different producer, for each of the thirteen (13) Preliminary events—a total of thirty-nine (39) tracks nationally.

  4. If a producer is selected to compete at one of the Preliminaries, the producer is no longer eligible to compete at the other Preliminary events.

  5. Event Managers have the sole discretion to make determinations of contestant eligibility, which are binding and final in all respects.

  6. Contestants will be notified and confirmed by Event Managers. Producers will need to verify their identity and citizenship.

  7. Producers must be present at and are solely responsible for getting to the Preliminary and Semifinal events within their region.

7. ATTENDANCE AT EVENTS

  1. Contestants are solely responsible for getting to and from Preliminary and Semifinal events, as well as, any related expenses or accommodations.

  2. Contestants who don’t make it to their events will be disqualified. The remaining contestants will compete and advance based on the highest score.

  3. For each Finalist and one (1) guest, Sponsor will cover air and ground travel to the Grand Finale, and provide one (1) double-room accommodation for two (2) people for two (2) nights.

  4. Sponsor shall not be liable for: i) any failure of transportation, accidents, incorrect directions or the inability for any Contestant to appear at an event; nor ii) any sickness, injury, damages or loss traveling to or from Events.

  5. Sponsor and Event Managers reserve the right to route Semifinalists to Semifinal events to best serve and balance the load of contestants competing at Semifinal events. Cases in which the Sponsor or Event Managers have to move Semifinalists outside of their region, Sponsor or Event Managers may cover travel costs and accommodations for those Semifinalists. Sponsor or Event Managers are not responsible for travel, accommodations or related expenses of guests of semifinalists.

  6. Sponsor and Event Managers shall be not be liable for failure, cancellation or delay of Contest Events if such failure or delay is due to causes beyond its reasonable control including, without limitation, accidents, nuclear or natural catastrophes, fires, earthquake or storm, strikes, failures of public utilities or common carriers, civil or military disturbances, acts of war, or intervention, acts restraints or regulations of any governmental authority, including compliance with any order of any governmental considerations. In such circumstances, the event winner will be determined by the scoring system: to evaluate submission tracks if event is a Preliminary event; or based on cumulative score if event is a Semifinal or the Grand Finale.

8. JUDGING

PRELIMINARY AND SEMIFINAL EVENTS

  1. Judging will take place at the events, with a panel three (3) to five (5) judges, comprised of music industry veterans, artists, producers and tastemakers.

  2. Judges are tasked with choosing one amateur producer to advance after two (2) rounds.

  3. Judges will listen to each of the tracks played by the competitors, and give a rating of 1 (not good) to 10 (very good) for each of the following criteria:

    1. Originality

    2. Complexity

    3. Production Quality

    4. Ability To Move The Crowd

    5. Radio/Club Hit Readiness

  4. The judges’ votes will be tallied, and the highest score will advance.

  5. If there is a tie, the winner will be decided by crowd vote.

GRAND FINALE

  1. Finale judging will take place at the event, with a panel three (3) to five (5) judges, comprised of music industry veterans, artists, producers and tastemakers.

  2. Judges are tasked with choosing one national winner over a series of four (4) rounds: a remix round—which will be scored, but not result in any eliminations; and three (3) knockout rounds—the first eliminating two (2) producers based on cumulative scores from the remix and first knockout round, and the two remaining knockout rounds eliminating one (1) producer each based on cumulative scores.

  3. Finale judges will listen to each of the tracks played by the competitors, and give a rating of 1 (not good) to 10 (very good) for each of the following criteria:

    1. Originality

    2. Complexity

    3. Production Quality

    4. Ability To Move The Crowd

    5. Radio/Club Hit Readiness

  4. The finalist with the highest score will win the Contest.

  5. If there is a tie, the winner will be decided by highest cumulative score entering the Grand Finale. If the last standing finalists were tied entering the Finale, the winner will be determined by crowd vote.

9. PRIZES

  1. There will be one Grand Prize winner chosen at the national Grand Finale competition event in Las Vegas.

  2. The winner of the Grand Finale will receive: a $4,900.00 Guitar Center gift card and a Winner’s plaque.

  3. Each of the four (4) remaining finalists will receive a prize pack valued between $1000 – $1500. Prizes to be determined at the discretion of the Sponsor.

10. GENERAL RULES OF PARTICIPATION

  1. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final, and waive any right to claim ambiguity in the Contest or these Official Rules. In the event of a dispute, the decision of the Sponsor shall be final and binding.

  2. All federal, state and local laws apply. All federal, state or other tax liabilities arising from this Contest will be the sole responsibility of the prize winners.

  3. In the event of your death during the Term, we shall have the right, in our sole discretion, to either immediately terminate this Agreement or continue to use the materials in which you participated upon payment of the required compensation to the executor or administrator of your estate or other appropriate party.

  4. The Sponsor, their parent companies, affiliates, subsidiaries and advertising and promotion agencies are not responsible for and shall not be liable for: (i) late, lost, delayed, misdirected, incomplete or unintelligible entries, telephone system or computer malfunctions, lost connections or transmission errors; (ii) any injuries, losses or damages of any kind caused by the acceptance, possession or use of any prize or from participating in the Contest; or (iii) any printing, typographical, administrative or technological errors in any material associated with the Contest

  5. Sponsor reserves the right, in their sole discretion, to modify, cancel or suspend this Contest should a virus, bug, computer problem or other causes beyond the Sponsor’s control corrupt the administration, security or proper play of the Contest.

  6. Sponsor may prohibit you from participating in the Contest or winning a prize if, in their sole discretion, the Sponsor determine that you are attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other players or Sponsor’s representatives.

  7. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION OF SUCH PARTICIPANT AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

  8. Sponsor reserves the immediate right to terminate this agreement and disqualify and/or have removed from Events, any contestant who has committed or commits any act or becomes involved in any situation or occurrence which brings you into public disrepute, contempt, scandal or ridicule or which shocks, insults or offends the people of this nation or any class or group thereof, or reflects unfavorably upon the Sponsor or Sponsor’s Products.

  9. If Contestant is terminated due to above stated morals, they will not be entitled to any additional awards from the Contest, but will not have to reimburse the monies paid out for contestant’s participation to that date.

  10. All entries and the information contained in such entries will become the property the Sponsor and will not be acknowledged or returned.

  11. Participation in the Contest will constitute permission for the Sponsor to use the names, cities, states, likenesses, and voices of the winners for advertising and promotional purposes, without any further compensation, unless prohibited by law.

11.OWNERSHIP OF INTELLECTUAL PROPERTY

  1. By entering tracks into the Contest, Amateur Producers grant Sponsor and Event Managers rights to use the musical tracks for promotional and advertising purposes only, in perpetuity.

  2. Amateur Producers ultimately retain the rights to the tracks they enter in the Contest.

  3. If the tracks selected for the Contest are sold or start to gain traction in the mainstream market, the Amateur Producer will maintain all rights to profits from the track.

12. LIMIT OF LIABILITY AND DISCLAIMERS

  1. ALL ENTRANTS AGREE THAT THE SPONSOR, ITS PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AND AGENCIES AND/OR ANY OTHER PERSON OR ENTITY ASSOCIATED WITH THE CONTEST SHALL NOT BE LIABLE FOR CLAIMS, LOSSES, LIABILITIES, EXPENSES OR INJURIES OF ANY KIND RESULTING IN ANY WAY FROM ENTRANTS PARTICIPATION IN THE CONTEST, INCLUDING BUT NOT LIMITED TO, THE DRAWING, THE USE OF THE PRIZE, ANY DELAYED, LOST, MISDIRECTED, OR DAMAGED ENTRIES, OR ANY COMPUTER, ONLINE SERVICE, COMMUNICATIONS OR OTHER TECHNICAL MALFUNCTIONS THAT MAY OCCUR.

  2. ALL ENTRANTS ACKNOWLEDGE THAT THE SPONSOR, THEIR PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AND AGENCIES AND/OR ANY OTHER PERSON OR ENTITY ASSOCIATED WITH THE CONTEST MAKE NO WARRANTY OF ANY NATURE, EXPRESS OR IMPLIED REGARDING THE PRIZES, WHETHER WITH RESPECT TO FITNESS FOR PURPOSE, SATISFACTORY QUALITY, DESCRIPTION OR NATURE OF THE PRIZE OR OTHERWISE. ALL ENTRANTS, BY ENTERING THE CONTEST, AGREE TO BE BOUND BY THE ABOVE RULES.

13. DISPUTES / CHOICE OF LAW

Except where prohibited, each entrant agrees that this Contest shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of this Contest, including without limitation barring entrants who do not comply with these Official Rules. By entering, entrants consent to the jurisdiction and venue of the appropriate federal, state and local courts located in New York for any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded.

15. USE OF INFORMATION

The information that you provide via interactive media in connection with the Contest may be used by Sponsor, Marketing Affiliate, and Related Entities in accordance with its Privacy Policy, which is found at http://remyproducers.com/privacy-policy and which may be updated from time to time without notice.
